Yes. However, the Code does not refer to any other legislation regarding product definition. And, if it is regarded as a vegetable it has to be unit priced per kg not per 100g.
This measurement unit problem is one of several reasons why I recommended that there be a new table of alternative units of measure when i was involved in making a submission to the review of the Code that started in Nov 2018 and has not been completed,
To date, the ACCC has not shown much interest in resolving this type of problem. However, I encourage you to complain to it about this possible non compliance with the Code and if you do I will be very interested whether you get a response, and if so what it is.
