We have many products on the market that are illegal to use in one or more situations but there is no prohibition on importing or selling them. It is part of our historic lightly lightly profits are important, red tape not so much (unless it is for the benefit of government revenue not government expenditure).
A clear example are unsafe products. Many products are supposed to meet safety standards but do not.
