What are the defects?

The products do not comply with the ‘Trade Practices (Consumer Product Information Standards) (Cosmetics) Regulations 1991 Statutory Rules 1979 No. 237’.

The products do not have English language labelling identifying the ingredients.

What are the hazards?

Use of the products may expose users to ingredients that they are sensitive or allergic to. If a user suffers an adverse reaction they will not be able to check the ingredients list to identify the possible cause and seek appropriate treatment.

What should consumers do?

Consumers who have purchased an affected product during the specified period should stop using the product immediately.

Consumers can return the product for a full refund. Returns and refunds only for the Ximi Vogue shop in Broadmeadows Shopping Centre, Broadmeadows, Melbourne, Victoria.

Perhaps Diaso Stores which sell mostly Japanese & similar product should also be looked at for the lack of clarity regarding ingredients in some of their products??

We often purchase from Asian or Japanese specialty grocers. Some products have stick on English language labels, while others have an English version package. The one difference may be that being a specialty store, it might be assumed every purchaser does so knowing it is a foreign product. The ACL does not provide an exemption, however the extent to which it is enforced is open to question?
