A very complex situation for all concerned. There may be serious consequences with the ATO if individual status is changed from independent contractor to employee?
Would this also be more of an issue in respect of workplace legislation and commercial/business law?
I have previouly worked on both sides of this arrangement. Possible instances of “sham contracting” may also alternately occur for the benefit of the contractor. Many of the considerations are remote from consumer law/regulation.
Hopefully the Federal Court action leads to a fair outcome.
