A new home for road vehicle recalls

Dear XXXX,

From 1 July 2021, road vehicle recalls will be published by the Department of Infrastructure, Transport and Regional Development and Communications (the department).

Road safety reforms

On 1 July 2021, the new Road Vehicle Standards Act 2018 (RVS) is replacing the existing Motor Vehicle Standards Act 1989.

The RVS reforms cover voluntary and compulsory recalls of road vehicles and approved road vehicle components.

Suppliers who voluntarily recall road vehicles (e.g. cars, caravans, commercial vehicles, campers, trailers) or approved road vehicle components will be required to notify the department, and the recall will be published on the department’s website.

These recalls will no longer be published by the ACCC. Current recalls on the Product Safety Australia website will be transitioned to the department’s recalls website.

Recalls remaining on the Product Safety Australia website

The following types of recalls will remain on the Product Safety Australia website:

  • vehicles that are not road vehicles but are classified as consumer goods (e.g. golf carts, miniature motor bikes, motorised mobility devices, quad bikes)
  • vehicle accessories (i.e. after-market parts that are not intended to be integrated into the road vehicle), that are consumer goods (e.g. child car restraint, portable ramp, recovery strap, bike carrier)
  • caravans and campers where the safety issue is not related to the vehicle itself but with human occupation (e.g. fridge, stove in caravan).

The ACCC will also continue to administer the compulsory Takata airbag recall.

For suppliers: submitting road vehicle recalls

Up until and including 30 June 2021, road vehicle recalls should be submitted to the ACCC via the Submit a recall form.

Note that recalls submitted close to 30 June 2021 may not be published on the Product Safety Australia website. Any unpublished recall notices will be transferred to the department to finalise and publish, post 1 July 2021.

From 1 July 2021, suppliers must submit their recalls using the department’s Road Vehicle Regulator (ROVER) system.

For consumers: searching for a road vehicle recall

Up until and including 30 June 2021, consumers can continue to visit the Product Safety Australia website for road vehicle recall notices. From 1 July 2021, consumers will be able to access new recalls from the department’s recalls webpage.

Past recalls will also be transitioned to the department’s recalls website by 1 September 2021.
