I have been doing some research and came across a great page from Appleā€™s environment page.

Basically there is a tile with the following text ā€œDurability you could fall forā€. You click on the tab and it starts ā€œBuilt to last as long as you love itā€¦ Durability is central to Appleā€™s product design. Our goal is to build long-lasting products that you can rely on to handle the rigours of everyday use. ā€¦ā€

Well I seem to have finally gotten a result. Had to go to VCAT. 6 month wait for hearing to be scheduled, and another 6 months to the actual hearing. Suddenly Apple want to settle (bare minimum).

So if you have the time to pursue your ACL rights then it works but boy it is an uphill battle.

Yes, if a business doesnā€™t voluntarily want to meet their obligations under the Australian Consumer Law, it can be a long drawn out process to ensure you chase your consumer rights. Some business know that this is the case, knowing that many consumers will possibly give up their claims due to the processes involved. It is a shame that a big company, like Apple, didnā€™t voluntarily want to assist you under the ACL when first contact was made.
